1. Introduction
These Terms & Conditions ("Terms") govern your access to and use of the website and digital services operated under the brand name AttunebyKripa, a sole proprietorship owned and operated by Kripa Suresh Lund ("AttunebyKripa", "we", "our" or "us").
These Terms apply to the Website, any future AttunebyKripa mobile application, and all digital content, products and services made available by AttunebyKripa, whether provided free of charge or for payment.
By accessing or using the Website, creating an Account or accessing any Digital Content, you acknowledge that you have read, understood and agree to be bound by these Terms.
If you do not agree to these Terms, you should discontinue use of the Website and any Services offered through it.
2. Definitions and Interpretation
2.1 Definitions
Account means a user account created through Google, Apple, Facebook or any other authentication method made available by AttunebyKripa.
Digital Content means any guided meditation, audio recording, video, workshop, online course, downloadable material, written content, illustration, graphic, image, logo, educational resource or other content made available through the Website.
Services means all products and services provided by AttunebyKripa, including but not limited to free and paid digital content, workshops, retreats, corporate programmes, courses, memberships and future offerings.
User, you or your means any individual accessing or using the Website or Services.
Website means the AttunebyKripa website and any future mobile application or digital platform operated by AttunebyKripa.
2.2 Interpretation
Unless the context otherwise requires:
a. headings are provided for convenience only and do not affect interpretation;
b. words importing the singular include the plural and vice versa;
c. references to any legislation include amendments or replacements of that legislation; and
d. the words "including", "includes" and "such as" shall be interpreted as "including without limitation."
3. Acceptance of these Terms
By using the Website, you agree to comply with these Terms together with the Privacy Policy, Cookie Policy and Medical & Wellbeing Disclaimer, each of which forms part of these Terms.
AttunebyKripa reserves the right to amend these Terms at any time.
Updated versions will be published on the Website together with the revised "Last Updated" date.
Your continued use of the Website following publication of revised Terms constitutes acceptance of those changes.
4. Eligibility
The Website is intended for individuals who are at least eighteen (18) years of age.
Individuals under the age of eighteen may only access the Website or participate in any Services with the consent and supervision of a parent or legal guardian.
By using the Website, you represent and warrant that:
you have the legal capacity to enter into these Terms;

AttunebyKripa reserves the right to suspend, restrict or terminate any Account where it reasonably believes that these Terms have been breached or that the Account has been used unlawfully or fraudulently.
6. Third-Party Authentication
The Website may permit authentication through third-party identity providers including Google, Apple and Facebook.
Your use of these services is governed by the terms and privacy policies of the respective providers.
AttunebyKripa does not control and is not responsible for the operation, availability or security of any third-party authentication service.
Where Apple Private Relay is used, AttunebyKripa may receive a relay email address instead of your personal email address.
7. Website Services
AttunebyKripa provides educational and wellbeing-related digital content and services through the Website.
The Services currently include, but are not limited to:
information relating to mindfulness and meditation;
guided audio meditations;
educational articles and resources;
information regarding workshops, retreats and events; and
user account functionality.
AttunebyKripa may, from time to time, introduce additional Services including paid Digital Content, online courses, memberships, workshops, retreats, mobile applications and other educational offerings.
AttunebyKripa reserves the right to modify, suspend, discontinue or replace any part of the Website or Services at any time, with or without prior notice.
Nothing contained on the Website shall be interpreted as creating an obligation on AttunebyKripa to continue offering any particular Service, feature or Digital Content.
8. Free Digital Content
The Website may make certain Digital Content available free of charge.
Free Digital Content is provided for your personal, non-commercial use and remains subject to these Terms.
Access to certain Digital Content may require you to create or log into an Account.
AttunebyKripa reserves the right to:

retreats;
memberships;
digital subscriptions; and
other educational offerings.
Where paid Services are introduced, additional terms relating to pricing, payment, cancellation, refunds and access may apply.
Those additional terms shall form part of these Terms where applicable.
Nothing in these Terms obliges AttunebyKripa to introduce or continue offering paid Services.
10. Intellectual Property
Unless otherwise stated, all intellectual property rights in the Website and its Digital Content are owned by or licensed to AttunebyKripa.
This includes, without limitation:
guided meditations;
audio recordings;
videos;
written content;
articles;
workshop materials;
course materials;
illustrations;
graphics;
photographs;
logos;
branding;
website design;
downloadable resources; and
any future Digital Content made available through the Website or mobile application.
These materials are protected by applicable intellectual property and copyright laws.
Except where expressly permitted in writing by AttunebyKripa, you may not:
copy;
reproduce;
modify;
adapt;
translate;
publish;
distribute;
display publicly;
sell;
licence;
create derivative works from; or
otherwise exploit any part of the Website or its Digital Content.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
11. Personal Use and Streaming Access
Unless expressly authorised in writing by AttunebyKripa, all Digital Content is provided solely for your personal, non-commercial use.
Where audio or video content is made available through the Website, it is licensed for streaming only.
Except where expressly permitted by AttunebyKripa, you must not:
download Digital Content;
record or capture streamed content;
redistribute or share Digital Content;
make Digital Content available to others;
play Digital Content in a commercial setting;
use Digital Content in workshops, retreats, corporate programmes or public events; or
otherwise make the Digital Content available beyond your personal use.
AttunebyKripa reserves all rights not expressly granted under these Terms.
11.1 Recording and Rebroadcasting
Unless expressly authorised in writing by AttunebyKripa, you must not record, reproduce, broadcast, livestream, retransmit or otherwise capture any Digital Content made available through the Website, whether in whole or in part.
This restriction applies irrespective of the method used to capture the content, including screen recording, audio recording, video recording or any other recording technology.
12. Acceptable Use
You agree to use the Website lawfully and responsibly.
You must not:
use the Website in breach of any applicable law;
interfere with or disrupt the operation or security of the Website;
attempt to gain unauthorised access to any part of the Website;
upload or transmit malicious software, viruses or harmful code;

18.1 No Professional Relationship
Your use of the Website or participation in any Digital Content or Service does not create a therapist-client, doctor-patient, counsellor-client, fiduciary or other professional relationship between you and AttunebyKripa or Kripa Suresh Lund.
Any guidance provided through the Website is intended solely for educational and wellbeing purposes and should not be interpreted as personalised professional advice.

your infringement of any intellectual property rights;
your violation of any applicable law; or
any unauthorised use of your Account.
22. Force Majeure
AttunebyKripa shall not be liable for any delay, interruption or failure in the performance of its obligations under these Terms where such delay, interruption or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labour disputes, internet or telecommunications failures, cyberattacks, power outages, government action or the failure of third-party service providers.
23. No Guarantee of Outcomes
Mindfulness, meditation and sound-supported practices are personal experiences, and outcomes may vary between individuals.
AttunebyKripa does not guarantee that participation in any Digital Content or Service will result in any particular outcome, improvement or benefit, including improvements in physical, emotional or mental wellbeing.
Any examples, testimonials or descriptions of personal experiences shared on the Website are provided for illustrative purposes only and should not be interpreted as guarantees of similar results.
24. Emergency Situations
The Website and its Services are not intended to provide emergency medical, psychological or psychiatric assistance.
If you believe that you or another person is experiencing a medical or mental health emergency, you should immediately contact the appropriate emergency services or seek assistance from a qualified healthcare professional.
AttunebyKripa does not monitor users in real time and cannot respond to emergency situations.
25. Changes to Digital Content

Nothing in this clause prevents either party from seeking urgent or interim relief from a court of competent jurisdiction where such relief is reasonably necessary.

These Terms, together with the Privacy Policy, Cookie Policy, Medical & Wellbeing Disclaimer and any additional terms applicable to specific Services, constitute the entire agreement between you and AttunebyKripa regarding your use of the Website and Services.
They supersede all prior discussions, representations or understandings relating to the subject matter of these Terms.
32. Assignment
You may not assign, transfer or otherwise deal with your rights or obligations under these Terms without the prior written consent of AttunebyKripa.
AttunebyKripa may assign or transfer its rights or obligations under these Terms in connection with a business reorganisation, sale, merger or transfer of its business or assets.
